The Procurement department are responsible for delivering best value and cash releasing savings against operational and strategic procurement activity, while simultaneously endorsing procurement best practice and probity compliant with both Trust and EU policies, procedures and directives.

 

 

Trust procurement procedures

 

Procurement Activity Exceeding EU Financial Thresholds

 

The Trust’s procurement activity is regulated by EU and UK legislation, supplemented by its own Standing Financial Instructions. There is a legal requirement for the Trust to comply with EU Directives when purchasing supplies, services and works. Additionally the Trust must adhere to non-discriminatory principles of openness, transparency and equality, and further demonstrate the achievement of best value and sustainability across the supply chain.


Large contracts for the provision of supplies, services and works which exceed prevailing EU financial thresholds will be advertised in the ‘Official Journal of the European Union’ (OJEU). The current financial thresholds applicable until 31 December 2009 are:


Supplies and Part A services    £90,319 
Part B and certain other listed services      £139,893 
Works    £3,497,313

 

All thresholds are net of VAT.


These values are not annualised. Instead they refer to the total contract value over the life of the contract. In accordance with EU regulations the majority of Trust contracts are awarded up to a maximum of 4 years.


The competitive tendering procedure adopted by the Trust under EU regulations is determined by the intricacy (and occasionally urgency) of individual procurement projects. All EU tenders however adhere to a mandatory 10 day standstill period at the end of the tender process, affording suppliers opportunity to receive relevant feedback concerning their tender submission and the tender outcome prior to a formal contract award being made.

 

 

 

Procurement activity below EU financial thresholds

 

For procurement activity valued below EU financial thresholds the Trust’s Standing Financial Instructions apply:

 

£5,000 to £10,000         At least two written quotations
£10,001 to £25,000 At least three written quotations required
£25,000 to EU threshold   Four tender required

 

At the discretion of the Head of Procurement or Director of Estates the requirement to obtain competitive  tenders/quotations can be waived up to the prevailing EU financial threshold.

 

 

All our contracts valued in excess of £90,319 are advertised on TED (Tenders Electronic Daily): the online version of the 'Supplement to the Official Journal of the European Union', dedicated to European public procurement.
